Land use planning procedures are obligatory for everyone

According to the law of Ukraine “About land use planning” land use planning is the array of social-economic and ecological actions, which directs on regulation of land relations and rational organization of the political subdivision, subjects of conducting the household. The main purpose for which land use planning is doing is rational usage, guard of lands and their registration.

There is a list of cases when land use planning is leading as a must on lands of all categories independently from the form of property.

Types of documents of land use planning are also fixed. One of the documents is technical documentation of land use planning about making the documents which verifies the right on the plot.
Technical documentation of land use planning proving the right on the plot, according to the Art. 56 of the Law include:


a) explanatory note;
b) technical work for the making the documents which verifies the right on the plot;
c) copies of applications physical or intercession of legal persons;
d) materials of fields, geodetic works and plan of the plot which was made by the results of cadastral survey;
e) decision of the executive agency or local authority about giving or disposition of the plot as a property or giving for use, including renting;
f) statement of transfer and acceptance of laws in safe custody;
g) act of shift to the location of boarders of guard territory, area of sanatorium guard, sanitary protection zone and areas of the special regime of usage the land while their presents;
h) cadastral plan of the plot;
i) list of restrictions of rights on the plot and land easement. Easement is the right of restriction usage of someone else’s plot, for example the right of passing, driving or drift fence of animals through someone else’s plot and etc.
