Purchasing plots by foreign legal persons

1. In the range of populated locality (part 2 art. 82). Foreign legal persons could buy a right of the property for plots not agricultural purpose in the limits of populated localities:
- In case of buying properties;
- For construction of objects connecting with entrepreneurial business in Ukraine.

Way of buying (part 2 art. 129) only while registration of all time entrepreneurial business with the right of business activities on the territory of Ukraine (part 2-3, 5-6 art. 129) is carried out by coordination with Cabinet of Ministry Ukraine by following councils:
- Council of Ministry AR Crimea
- Kiev city state administration
- Sevastopol city state administration
- Village councils.

Give in a request in corresponded councils and after agreement with Cabinet of Ministry Ukraine it is taking into consideration by corresponded council.
To the request applies copy of the contract about rent of land, copy of certificate about registration of foreign legal person the registration of all time representation with the right of conducting business on the territory of Ukraine.

2. Beyond populated locality (part 2 art. 81). Foreign citizens and people without citizenship could buy right of the property for plots of not agricultural purpose beyond populated locality, where there are property which possess to them on rights of private property.
Way of buying (part 1 art.129) is carried out by coordination with Cabinet of Ministry Ukraine by agreement with Verkhovna Rada Ukraine.

Buying plots by foreign physical persons:

1. In the range of populated locality (part 2 art. 81). Foreign citizens and people without citizenship could buy right of the property for plots of not agricultural purpose beyond populated locality, where there are property which possess to them on rights of private property.
Way of buying (part 3 art. 81). Foreign physical persons could buy a right of property for plots of not agricultural purpose in the range of populated locality in cases:

a) buying by purchase and sell contract, deed of gift, exchange other agreements;
b) buy-out of plots with properties which possess to them on rights of private property;
c) inheritance.

2. Beyond populated locality (part 2 art. 81). Foreign citizens and people without citizenship could buy right of the property for plots of not agricultural purpose beyond populated locality, where there are property which possess to them on rights of private property.
Way of buying (only in case of possessing property which located on this plot)
a) buying by purchase and sell contract, deed of gift, exchange other agreements;
b) buy-out of plots with properties which possess to them on rights of private property;
c) inheritance.

Right of plot’s rent (art. 93):
1. Right of plot’s rent is quick paid possession which is based on contract and usage of plot which is necessary to renter for business and other activities.
2. Plots could transfer for rent to citizens and legal persons of Ukraine, foreign citizens and people without citizenship, foreign legal persons, international organizations and also foreign countries.
3. Rent of plot could be for short time – not more than 5 years and long – not more than 50 years.
4. Rented plot or its part could be, with renter agreement, passed for rent to other person (sub rent).
5. Renters of plots are their owners or authorized people.
6. Relationships which connected with land rent are regulated by law.

The order of transmitting of plots for rent (art. 124):
1. Transmission plots for rent which are in state or communal property, is made on the basis of corresponded agency of executive branch or local authorities while concluding the contract for plot rent.
2. Transmission for rent plots which are in a property of citizens and legal persons is made according to the contract of rent between owner and renter.
3. Transmission for rent plots which are in a property of citizens and legal persons with changing target purpose and from reserve lands under construction is made by the project of movement, in fixed order by articles 118, 123 of the Code.
