Conditions of privatization of summer cottage
From 1992 after the government decree about land reform, the word privatization is familiar to all Ukrainian citizens. Till this time all land possessed to the country and after denationalization it divided into three main forms: state, municipal and private.
The number of documents, which is necessary for privatization land, depends on target quality of the plot. But in any case it will be needed passport and identical code – they are main documents of the citizen. The order of the privatization’s procedures is established by Land Codex of the Ukraine, which works from the year of 2001.
Privatization is free of charge. But some procedures which are necessary for forming main documents for the land are paid.
First stage is choosing organization of the use of land where you will be helped to collect and worked all necessary documentation. More documents and information about interested plot you will collect then quicker everything will be done in your favor. If plot is in some garden cooperative then you have to show the certificate with print and signature of representative that you are a member of this association with indication of your term of usage the land. Also it is necessary to show the copy from the plan of parting the territory and information about join owners of land, other users if there are some, with necessity to form the document which proves that this land is given for the construction.
For privatization the plot for construction you should have permission from city council for doing works of constructions before gave the project for the session of the council, conclusion BTI and permission from sanitary-epidemiological agency, committees of environment protection, monuments of architecture, controlling the land resources, conclusion from State Municipal Enterprise “Sevgorvodokanal” and etc. It is necessary to show for what purpose will be using built constructions.
If there are some constructions on the plot then it is also necessary to show all documents which prove the right of property, for example, contract of purchase and by or deed of gift.
Second stage of privatization is getting the permission from the city authorities. While privatization for leading the individual gardening or for construction and servicing of living house, constructions and buildings the decision is made by administration which is in the location of the plot, in case if this plot was already in use. City council is made decision in case of new construction on the new place.
In average the preparation and work with documents of specialists land organizations cost from 500 to 800 hryvnas. Otherwise, as a result, is summing up the separate cost of different procedures, for example, forming of land allotments, broadening the territory and etc.
The most expensive service is geodesic expertise which is necessary in all cases of forming the privatization. Its average cost is 400 hrivnas.
The cheapest by forming (about 150 hryvnas) is privatization of summer cottage for gardening.
Documents for plot are necessary to forming. In other case, someone who decided to use it and do not inform anyone, sooner or later should meet with State inspection of using and protection the land control.
Now the punishment for self-trapping or for not appropriate use of the territory are not to serious for physical persons, it is a penalty from 1 to 10 not tax minimal in case of first warning. If the first penalty will seen mot serious ground for any changes of his position, then the sum of the second penalty will increase and from the inspection to the Office of Public Prosecutor come an application and later trial. In this case, free, give and compensate should be done quickly and fully.
Such measures were ineffective that is why, there were a lot of violations of land legislation. But very soon the situation will change for better, while now the legislation is under consideration, which established the criminal responsibility for serious violations.
