Are all reconfigurations considered illegal and pertain to agreement?
Any reconstruction of accommodation even small is reflected in technical passport. If owner does not have permissive documents it brings following legislation of done changes. However, it should be mentioned that agree not every change. In February was issued the order of the Ministry “About confirmation of changes to the instruction about the order of conducting the technical inventory of objects of real estate” where specified and added types of construction works, which are not related to self-willed construction. Now according to the changes, are regardless of following (so, stamp talking about self-willed rebuilding is not made):- reconfigurations in block of flats which are not connected with changes of living or additional square without disturbance of supporting constructions;
- enlargement of living and additional square through dismantlement of divisions, closets, wrecking of stoves, fireplaces, glassing of balconies, recessed balconies, equipment of door ways in internal not main walls;
- rearrangement in divisions of accommodation equipment;
- running repairs of houses and constructions without changing of purpose of accommodation.
However, part I of Instruction was added with point 1.6: “For residential houses, planning, having built, rebuilt according to norms SNIP 2.08.01-89, demands of State constructive norms from 2005 are not spread.” This point does not give an opportunity to handle additional in Changes list of constructive works which does not refer to self-willed building.
According to Changes in Instruction, in case of building garden houses do not refer to self-willed building:
- building on the lot temporary constructions which does not demand doing works with system of foundation;
- rearrangement of equipment inside the accommodation;
- system or closing door ways and windows area;
- increasing or decreasing square through stripping down or arranging divisions;
- closets, wrecking stoves and flag stones;
- reconfigurations are without changing living or additional square.
Before such temporary construction did not take stock how stall and metal garages. Today with spreading of technologies of quick building constructions, which does not demand capital development, objects, which are built in such way pertain to technical inventory. Now, how is written in Changes of Instruction such objects, including trade, household stalls and pavilions, metal garages pertain to technical inventory. In this case the procedure of inventory does not change.
