Flats’ crooks can "like" New Housing Code

Reformation of Housing and public utilities are impossible without using Housing Code and it will be under consideration in Verkhovna Rada at the end of current year.

Besides, in working project there are a lot of arguable articles, one of which “could be the favorite article of flats’ crooks”.

Housing and public reform is blocked according to the politic situation in the country. Ministry of Housing and public utilities of Ukraine finished the work under the project of new Housing Code. People criticize this project today and this critic is founded.

It should not be allowed that in new Housing code appears the norm which let local authorities move citizens, living in the houses which are under destruction or which are going to be reconstructed, in any districts. Also it should be fixed in the Law the minimal norms of living and Total Square, lower does not allowed the accommodations from state or municipal fund, while the right of the citizens for the good residence is written in the Constitution. But enlargement the powers of state officials, according to the project, which allowed them to interfere in housing regulation, which are in the private property, which are against the principles of inviolability of the right of property.

In the article 110, which regulate the questions of flat payment, should be added legislative the norm for the equal rate for all citizens for usage of gas, water and other natural recourses, which liquidate for the present moment the discrimination. Today municipal officers divide people for the several categories according to their view. One pays less, other more and third a lot. This discrimination politics is ant constitutional and the problems of poor citizens should be solved at the expense of state subsidies.

In case of acceptance of the article 119 of new project of Housing code which could be the favorite article of flats’ crooks, anyone could demand of owner to make forced exchange of the property, offer him not profitable conditions and then take it to court.

Generally, government has a lot of time to remove from the project those sharp moments which cause to disagreement, taking into account that fact that at the present time in case of pre-time elections, the parliament could not view the project of Housing code till November. By this time it will be more reasonable to improve the present project of the Housing code and give it to consideration of the deputies “in package” with Law “About principles of residential politics in Ukraine”.

At the time Cabinet of Ministry is approved the project of new Housing code, which foresee the residential construction at the expense of different ways of financing. Accept this, the project foresee the creation of trade structure of managing of Housing recourses, going to the payment Housing and public services by its prime cost and providing social protection of the citizens and also creation while construction new many storey buildings the joining of properties.
