If the owner of the accommodation is legally incompetent person

In case if citizen is legally incompetent or limited capacity he is needed in care or in protectorate. According to the civil code of Ukraine it depends on limitation of capacity (acknowledging of legally incompetent or limited capacity) such citizen has legal circumstances as for opportunities of making some rights. Physical person, who civil capacity is limited, can make just some small deals. Deals are as for ordering property and other deals which are within the limits of small common are made by such people with agreement of guardian.

Legally incompetent physical person does not have a right of making any deals. They are made in his interests and from his name his guardian but only with agreement of agency of guardianship and protectorate. Working protectorate fix the responsibility of guardian by making a contract which are for notarization and (or) state registration, including contracts of separation or exchanging the house, apartment, to get a permission of agency of guardian.

In this case if seller is legally incompetent or limited capacity then first of all we should make sure in it, while physical person is admitted to be incompetent only by court. After this it should be found out who is his guardian or protectorate. After making a decision about buying a property you should have permission from agency of guardian and protectorate for making a deal. But also you should check was this person in marriage in that time of buying this property, are there registered people on this address. Establishments of these facts is depends on deal realization.
